Starting a Real Estate Business

The real estate industry is very sensitive to economic changes like interest rates and the cost of materials in building houses. Interest rates in particular can easily swing the number of sales that are completed during any quarter of the year. Rising interest rates will slow down the sales and falling rates will aid the sales of real estate. This is an important fact in the real estate business as this can absolutely cause rapid changes in income from the sales that can be made.

With this in mind, the time to buy an agency that comes up for sale may be when the real estate business is in the doldrums. A hot real estate market will make an existing firm worth more, as their income will be higher during this period of time. Of course if you follow this course of action, you will have to wait out the slow down in the markets. Another factor in the purchase or start-up a real estate company is the state licensing requirements.

Most states have serious requirements for real estate agents and brokers. Brokers have a much stiffer requirement in most states than an agent. The requirements include passing exams and a fixed number of educational hours for both agents and brokers. There is also a requirement for continuing education. These state mandated steps to a career in the real estate business would have to be met before an agency could be purchased or started. Since this industry is regulated and has strong legal steps to comply with, this licensing plus experience would be an initial step to being an owner in this field. This is not a business that can be stepped into by just paying out some money.

An agent can have the goal of owning their own firm, but it will take planning and meeting the state rules to make this happen. Once a potential owner has these steps out of the way, finding an existing business to buy will be in order. A quick check of real estate business listings reveals that they are usually found in larger cities and the asking price is significant. There are also resales of franchise companies. Just typing into a search engine, “Real estate businesses for sale”, came up with this quick check. A buyer could also check with business brokers and real estate brokers in their city. Another source worth checking out would be a franchise connection. An in place real estate business is advantages as the name is already known and will get clients due to this. When you start a company from the ground up you do not have this advantage. An existing business with several locations will come with a higher price tag than what you could start your own business for.

Another way to gain ownership would be buying into an existing business. This could work if you have a solid relationship with the current owner. The problem is you will not have the final say in most decisions unless you are buying controlling interest.

Specialty real estate firms

Most people think about a firm that helps with the buying and selling a home. There are several other areas of specialization. A real estate firm could become expert in buying and selling commercial property, farmland and farms, farm product processing plants, rental properties and shopping centers. Actually a broker could cut out a niche market from many that are available in the real estate business. If you have an area of expertise, this could become something that could be marketable and cut out a lot of competition in certain situations. Some real estate firms have unique departments that handle certain types of real estate marketing. The decision you must make is what kind of a firm are you going to own. You may have to start your own in order to make it happen.

You could also get into real estate management and the buying and selling of these rental properties, which is a very unique part of the industry. Shopping center related firms could be in from the start of a project. They can help with the formation of the firm to build and own the property and then handle the rentals and day-to-day management of the center.

The point of all of this is there are areas of real estate specialization that lend themselves to a business that just works in this real estate category.

Finding the money to make your dream happen

You may not have the total purchase price for an existing business. The question is how do you come up with the balance to make the deal. Finding a source to lend you the money is one way to come up with the needed funds. There are businesses that offer loans to new owners of businesses. These can be found on the Internet by just doing a search. Family and friends could be another source of money. One way to get the needed money is to take in a partner for the business. If you have a friend in the business maybe they would be interested in owning part of the existing company. All of these possible money suppliers will have different requirements for paying the money back.

Make sure you can see your way clearly on how you will accomplish the pay back. This business can be adversely affected by interest rates so you would need a second way to make the payments. A person thinking about ownership in this field must remember that it can be feast or famine as far as sales and commissions go. This is not like being in the restaurant business or owning a printing company. Successful brokers can make considerable money in a good market. They can also have periods that are very tight as to sales. The brokers that succeed have a policy of putting away some of their earnings during good times to cover the less profitable times. Doing this just shows the broker has a realistic view of the business.

Conclusions

This business can be extremely profitable during low interest rate economies. The legal and state requirements make the ownership of a brokerage firm more difficult to own than is the case with other businesses. Buying and selling a real estate business is somewhat more difficult due to the restrictions that are placed on the owner of a real estate firm. You must have the appropriate licenses in place before you can begin operation. This is true whether you buy a company or start one up from scratch. Finding a firm you can afford will take some time and research on your part. Hiring a professional business broker may speed up the search.

Deciding early on if you want to be a specialist will set other decisions in place. Niche areas that you are an expert in will help cut the competition somewhat. A general real estate business will have the potential for more clients, but will need and ongoing advertising campaign to gain listings and clients looking to buy. The start-up is cheaper to open, but will have little cash flow like an existing firm. Money flow is the one huge advantage buying an existing business offers to the new owner.

Real Estate Commission – A Corrupting Influence

Real estate commission is the way in which real estate agents are paid for the services they provide. They receive a percentage of the price received for the property. Effectively, the real estate agent requires the seller of a property (the vendor) to sign over to the real estate agent a part of the property being sold.

Another way of looking at it is to say that the real estate agent, through the wording of the listing contract, effectively has his name added to the title deed of the vendors property, so that the real estate agent becomes a part-owner of the property. When the property sells, the real estate agent receives a payment that represents his share in the vendors property.

Most readers will be aware of the arguments in favour of real estate sale commissions, so I wont discuss those here. My focus is on the ways in which the sale process can be skewed against all parties involved, when the motivation to win a commission takes precedence over more important considerations.

Commission is a winner-takes-all, loser gets nothing situation. This increases the pressure on the real estate agent to secure a sale. Time is also a problem. If the real estate agent cannot secure a sale within a time acceptable to the vendor, the vendor may take the property off the market, or away from the real estate agents agency. This will result in a total loss for the real estate agent.

Finally, the vendor becomes an obstacle between the real estate agent and his commission goal. In order to receive payment for his share of the vendors property, the real estate agent must receive an offer to purchase within the available time, but the offer must be accepted by the vendor. If the vendor decides that the offer is not acceptable, then the real estate agent loses.

In order to win the gambling game that is real estate sales, the real estate agent may decide to tip the odds in his favour and there are numerous ways in which this can be done.

At the listing stage the real estate agent may use improper means to win the listing contract. These include over-quoting on valuation, and offering dodgy sales figures.

During the sale process the real estate agent may be tempted to tell potential purchasers things that are untrue. I have seen many sale contracts with clauses designed to protect real estate agents against the consequences of false statements. Known as porkies clauses, they invariably state that the purchaser acknowledges that any information provided to the purchaser by the real estate agent is provided on the understanding that the purchaser will not be relying on it for any purpose.

When a purchaser has submitted an offer, and the purchaser cannot be convinced to increase her offer, the real estate agent may be tempted to pressure the vendor into accepting what would otherwise be unacceptable. Observations, such as the market has softened or the market has spoken to us are used by real estate agents to convince vendors that the real estate agents high estimation of value can no longer be relied upon, and that the vendor should now accept what the vendor believes is an unacceptably low offer.

For some years now, I have been arguing that real estate services should be provided on a fee-for-service basis.

I will explore the replacement of real estate sale commissions with a fee-for-service structure further in future articles.

Real Estate Investing Financing Truths – Part 2

No Money Down and other ‘Creative’ Real Estate
Investment Methods

For many years, investors have seen the traditional
real estate investment methods described in Part 1
of this article as a lot less than desirable!

They began looking at the prices of houses and
finding methods of bringing the price more in line
with making more money in a faster way.

These savvy investors developed ways to get loans
on properties that allowed them to pull money out
whenever they buy a real estate investment (cash
back at closing) and lower their payments to build up
their cash flow (‘creative’ investing).

They even developed methods of determining a
Sellers motivation for selling – and bought the
property at a discount price.

These creative investors also saw that some Sellers
were not able (for whatever reason) to sell the
property at a discount price, however, they still
needed to get rid of the property, as they didnt
know how to manage it as a landlord, or make
money from it – not that it couldnt be done, they
simply lacked the knowledge of how to do it.

The Seller just never learned how to profit from a
real estate investment.

These investors understood how to make money
from such properties, and did.

They bought the property on discount terms, and
made money from the spread by selling it at retail
price and/or terms (certainly one of my favorite
methods of real estate investing).

Buy Every Real Estate Investment via Discount Price
or Discount Terms.

Several years ago (actually, it really took off in the
1980s), Real Estate Investment Experts began
seeing the potential for making money in bringing
this treasured knowledge to the public in the form of
home-study courses, seminars and Boot Camps.

They found that it wouldn’t create competition for
themselves, as many people, even though they
purchase real estate courses and attend seminars
and Boot Camps, will not actually take the
information and utilize it to make the hundreds and
even thousands of dollars possible for anyone
serious about Real Estate Investing.

These Real Estate Investment Experts (being
dubbed ‘guru’) found that this side of the business
was lucrative often making more income from
teaching about real estate investing than the actual
real estate investments themselves.

It is important to understand that these real estate
investment gurus learned early that they can only
teach others what to do, not be responsible for the
other persons success.

Providing the information to those that choose not
to use it is very similar to the old adage “You can
lead a horse to water, but you cant make it drink”.

Yes, these real estate investment gurus got wealthy
from selling this information, but their theories,
principles and techniques taught thousands of
others (those that take action on what they learn)
how to realize their dreams utilizing their tried and
true methods of real estate investing.

From home-study courses and seminars, to boot
camps and one-on-one training, these methods
have been proven to be not only interesting to
millions of people, but capable of bringing massive
wealth to those that take action on what is taught -
those that go on and actually make real estate
investments themselves.

Knowledge changes things…

This knowledge of no money down real estate
investing techniques being known by thousands of
Sellers has made changes in the industry.

By bringing the Seller into the knowledgeable realm
of Real Estate investing, Sellers now know many of
the methods that the gurus teach.

This is both a blessing and a curse.

To the talented investor, these knowledgeable
people are more likely to work to create a WIN-WIN
situation.

Investors that avoid the tricks and stick to the basic
real estate investment techniques and terms that
have been proven to work over and over again,
have proven these powerful real estate investment
strategies work even with these informed Sellers.

Oh, yes, many of these real estate investment
techniques work today, as they have for many
years. So much so that it is almost possible to say
they have become principles; things that work, over
and over, the same way no matter what happens -
like gravity.

However, sadly, they are not really principles, as
several of the real estate investment methods and
techniques that worked in the 1980s and even
through the 1990s are today not as powerful, nor do
they work as often as they did before (although
some ‘gurus’ are still teaching the same methods -
even after 20 years…).

Some of this decline is due to a more educated
society (due to the flood of real estate investment
information available via books, tapes, home-study
courses and the Internet), while some of it is due to
simple changes in policies and laws.

It seems like a wave started late in 2003, the FHA
announced that flips (transactions where investors
buy houses cheaply and sell them at or near market
rates) are “illegal”. (Note that illegal in this context is
not a legal term, but one that has been adopted
from “you are not allowed to do that and do
business with us”.)

The FHAs announcement started a wave of concern
(if not panic) throughout the Real Estate investing
community.

Title and Mortgage companies began to tighten up
their reigns. Many of these companies, in lieu of
direct information, began simply not completing any
transactions that did not follow the traditional real
estate investment system. This made it hard for
investors to complete transactions that involved
simple buy-then-resell agreements (as they are not
really real estate investments, but a rather nice way
to make some fast CA$H!).

In rapid appreciation areas (California and Nevada,
for example), the ability to flip a property all but
stopped (became ‘illegal’). All the ‘traditional’
creative real estate investing methods were virtually
put on hold.

Ingenuity to the rescue, other methods of real
estate investing always seem to pop up. After all,
“Necessity is the Mother of Invention”, and “Where
there is a Will, there is a Way” are absolute
principles.

Investors have to make a way to get things done – a
way to keep their real estate investments profitable,
and even more creative real estate investing
methods were developed – to keep real estate
investors, and the love of real estate investment,
alive forever.

3 Major Things to Watch With Your Property Management Company

Are you thinking of moving out of your comfort zone and investing in another province or country? Are you going to hire a property management company? If so here are a few things to keep an eye on when working with a property management company.

Communication
Communication is the most important aspect when dealing with property management companies. Are they quick to return your phone calls or emails? If they aren’t responsive with you as the property owner, they probably aren’t responsive with your tenants, and that can be extremely hazardous to the health of your rental property. As property owners ourselves, we have found that you have to keep a close eye on your property managers. I’m sure to many of you that goes without saying, but if you’re using a PM company for the first time, you need to do some research into the company you are using and definitely shop around. Word-of-mouth is great, but if you don’t know anybody that can recommend a property management company in your area then you have to go with trial and error. Effective and timely communication makes life easy and quickly resolves issues. A communication breakdown is a HUGE issue and can cause all sorts of headaches. In a scenario like this don’t be afraid to fire your existing PM company and seek out a more competent company (you’re probably not the only customer they are screwing over!).

Solution: Establish a communication standard from the very beginning with your property management company and make sure it’s on paper. Hold them to that, and if they stray from the agreement at anytime confront them immediately and get them back on track. If they stick to the agreement it will make life a little easier, but if they continuously break the communication agreement you may want to find a new property management company that is willing to work with you.

Deferred Maintenance
It’s a wise policy to visit your rental properties once in a while, or have someone you know in the area do a quick drive-by and let you know if things are okay or in disarray. Home Owner Associations usually let you know right away if your tenants stray from the local bylaws, but if your PM company ignores the enforcement of the bylaws it can cost you money. In addition, if your PM company chooses to ignore some basic repairs, they will get worse over time and cost you more money down the road. It’s best to kill the monster when it’s small. Also consider your tenants moving out because repairs are not happening. Now you have to make the repairs in addition to paying a tenant placement fee that many PM companies charge to get a new tenant in your rental property. Deferred maintenance can hurt, so keep an eye on the property if you can, and make sure your property management company is doing their job.

Solution: Keep an eye on your property. Whether you occasionally visit the property or have a neighbor check on it, it’s a wise policy to catch any issues while they’re small and resolve them quickly. Your tenants will appreciate it and so will your blood pressure!

Wasteful Expenses
Just because you hired a property management company doesn’t mean you abdicate your responsibilities. If you have experience managing your own property and something needs a quick repair, you can get it done right away with minimal costs. However when using a PM company they typically make a service call to the local serviceman, hire them for the job, and they make a trip to your house and fix the problem. What can typically cost 20 bucks by visiting your local home depot can turn into hundreds of dollars with property management companies. Rule of thumb: service calls are never cheap, just keep in mind that this is the cost of doing business, but be sure to keep an eye on your expenses so they don’t get out of control.

Solution: Like the communication agreement, setup a repair agreement so that you can personally approve any and all expenses. Furthermore, if you happen to know a handy-man in the area that you trust, you can request that he gets the service call for any repairs.

7 Top Real Estate Investing Jobs

Real Estate investing has long been proven to make tons of
CA$H for the active investor and many of the real estate
investing methods and techniques used to make some of
the biggest (and quickest) CA$H only require a little time
and a bit of knowledge (i.e., NO MONEY and NO CREDIT!) to
rapidly bring home a really big check!

That is the appeal of Real Estate investing courses to most
people C to do deals that require little/no money or credit
yet pay back huge rewards for the time and knowledge you
get from following their systems.

Yet, the “investing” gets a bit lost in most of the world of
“Real Estate Investing” – there is no “investing” other than
a bit of time – there is no ROI (Return On Investment) other
than the time-for-money factor.

That is why I call these activities Real Estate Investing Jobs -
they stop bringing income as soon as you stop working
them.

Real Estate Investing through these jobs, while they make
you CA$H, will never give you financial freedom as they only
generate quick money and not long-term, passive income.

This article will look at some of the more popular methods of
Real Estate Investing jobs.

One of the biggest challenges to overcome is the fact that,
when discussing the money made through Real Estate
Investing, the numbers of dollars are much more than your
common corporate job, and many people simply are not
ready to handle such discussions.

You see, when you were very young, you were
programmed to think that $X was a large amount and often
this amount was only a few hundred, or perhaps, a few
thousand, dollars.

Yet, when discussing Real estate investing deals, there are
often multiple thousands of dollars at stake.

Most people simply are not used to discussing such
numbers, and wind up not making the money they could.
They simply have not learned the language of Real Estate
Investing.

One of the first lessons I teach my students is how to get
past the fear of discussing hundreds of thousands of dollars
and changing the programming you were given as a child to
form open ideas about money and investing to make even
more money.

One quick step you can do to begin this journey is to look
deep inside yourself and ask yourself how you feel about
money. Can you comfortably discuss figures in the hundreds
of thousands of dollars?

Most people learn quite quickly – with just a little bit of
practice.

With that in mind, it is time to look at these Real Estate
Investing Jobs more closely.

These ‘jobs’ bring you various levels of income, depending
on your area, so instead of discussing them in dollar values,
we will look at them from a percentage standpoint.

Of course, with these examples, the amount of work, time
and knowledge you put into it will certainly pay off more (or
less);

1. Property Profiling (birddogging) – this popular way to get
started in real estate investing provides a real estate
investing job with a decent income – something along the
lines of what a factory worker would make in the area.

2. Lease Purchase – this powerful tool can be utilized to buy
and sell property with no money out of your pocket (a Real
Estate Investing sandwich), while keeping a nice pocketful
of money for your time (can you tell this is one of my
favorites?) An active person can make about 1.5 – 3 times
more than the Property Profiler, on average.

3. Subject To – with a bit of training, you can make this
method of real estate investing really pay off big. Once you
know how to negotiate these deals, your real estate
investing income will reach that of corporate executives -
with much less of a time requirement.

4. Foreclosures – while highly lucrative and one of the top
income producing methods of real estate investing, the time
and knowledge required to actively pursue such deals is
becoming more difficult all the time.

The payoff to those that can perform these deals is huge -
about 10 times that of the Property Profilers, however,
finding deals is much more difficult due to the number of
people looking for them.

5. Tax Lien certificates – this is a true form of Real Estate
Investing – actually putting your money into something that
produces a return – one of the safest investments around
with returns that beat any other form of passive investing.
If you have money to invest, this is a great area to get into
with 15%+ return with almost no down side.

This is still a real estate investing ‘job’ as tax lien
certificates are short term, quick turn profit generators, not
sustained over time, plus they take skill and talent to make
the maximum profits.

6. Short Sales – this form of Real Estate Investing is another
job, as your knowledge level and timing are extremely
important. A lot of money can be made with this type of
Real Estate Investing job – as much or more than any other
form – once you know how.

7. Secondary notes/Purchasing Equity positions – a ‘higher
level’ of real estate investing, where more knowledge is
needed to limit the risk, however, the returns on equity
position purchases can be extremely high – from 6%-10%
for fully passive results and ‘sky’s the limit’ for purchasing
equity positions.

Yes, once you get past the internal false programming – the
LIES you have been taught all your life about money, you
can begin a successful career in Real Estate Investing -
through a variety of Real Estate Investing Jobs and then
onto true, full, watch-your-money-grow Real Estate
Investing.

3 Of The Top 9 Reasons That The Real Estate Bubble Is Bursting

If you own real estate or are thinking of buying real estate then you better pay attention, because this could be the most important message you receive this year regarding real estate and your financial future.

The last five years have seen explosive growth in the real estate market and as a result many people believe that real estate is the safest investment you can make. Well, that is no longer true. Rapidly increasing real estate prices have caused the real estate market to be at price levels never before seen in history when adjusted for inflation! The growing number of people concerned about the real estate bubble means there are less available real estate buyers. Fewer buyers mean that prices are coming down.

On May 4, 2006, Federal Reserve Board Governor Susan Blies stated that “Housing has really sort of peaked”. This follows on the heels of the new Fed Chairman Ben Bernanke saying that he was concerned that the “softening” of the real estate market would hurt the economy. And former Fed Chairman Alan Greenspan previously described the real estate market as frothy. All of these top financial experts agree that there is already a viable downturn in the market, so clearly there is a need to know the reasons behind this change.

1. Interest rates are rising – foreclosures are up 72%!

2. First time homebuyers are priced out of the market – the real estate market is a pyramid and the base is crumbling

3. The psychology of the market has changed so that now people are afraid of the bubble bursting – the mania over real estate is over!

The first reason that the real estate bubble is bursting is rising interest rates. Under Alan Greenspan, interest rates were at historic lows from June 2003 to June 2004. These low interest rates allowed people to buy homes that were more expensive then what they could normally afford but at the same monthly cost, essentially creating “free money”. However, the time of low interest rates has ended as interest rates have been rising and will continue to rise further. Interest rates must rise to combat inflation, partly due to high gasoline and food costs. Higher interest rates make owning a home more expensive, thus driving existing home values down.

Higher interest rates are also affecting people who bought adjustable mortgages (ARMs). Adjustable mortgages have very low interest rates and low monthly payments for the first two to three years but afterwards the low interest rate disappears and the monthly mortgage payment jumps dramatically. As a result of adjustable mortgage rate resets, home foreclosures for the 1st quarter of 2006 are up 72% over the 1st quarter of 2005.

The foreclosure situation will only worsen as interest rates continue to rise and more adjustable mortgage payments are adjusted to a higher interest rate and higher mortgage payment. Moody’s stated that 25% of all outstanding mortgages are coming up for interest rate resets during 2006 and 2007. That is $2 trillion of U.S. mortgage debt! When the payments increase, it will be quite a hit to the pocketbook. A study done by one of the country’s largest title insurers concluded that 1.4 million households will face a payment jump of 50% or more once the introductory payment period is over.

The second reason that the real estate bubble is bursting is that new homebuyers are no longer able to buy homes due to high prices and higher interest rates. The real estate market is basically a pyramid scheme and as long as the number of buyers is growing everything is fine. As homes are bought by first time home buyers at the bottom of the pyramid, the new money for that $100,000.00 home goes all the way up the pyramid to the seller and buyer of a $1,000,000.00 home as people sell one home and buy a more expensive home. This double-edged sword of high real estate prices and higher interest rates has priced many new buyers out of the market, and now we are starting to feel the effects on the overall real estate market. Sales are slowing and inventories of homes available for sale are rising quickly. The latest report on the housing market showed new home sales fell 10.5% for February 2006. This is the largest one-month drop in nine years.

The third reason that the real estate bubble is bursting is that the psychology of the real estate market has changed. For the last five years the real estate market has risen dramatically and if you bought real estate you more than likely made money. This positive return for so many investors fueled the market higher as more people saw this and decided to also invest in real estate before they ‘missed out’.

The psychology of any bubble market, whether we are talking about the stock market or the real estate market is known as ‘herd mentality’, where everyone follows the herd. This herd mentality is at the heart of any bubble and it has happened numerous times in the past including during the US stock market bubble of the late 1990′s, the Japanese real estate bubble of the 1980′s, and even as far back as the US railroad bubble of the 1870′s. The herd mentality had completely taken over the real estate market until recently.

The bubble continues to rise as long as there is a “greater fool” to buy at a higher price. As there are less and less “greater fools” available or willing to buy homes, the mania disappears. When the hysteria passes, the excessive inventory that was built during the boom time causes prices to plummet. This is true for all three of the historical bubbles mentioned above and many other historical examples. Also of importance to note is that when all three of these historical bubbles burst the US was thrown into recession.

With the changing in mindset related to the real estate market, investors and speculators are getting scared that they will be left holding real estate that will lose money. As a result, not only are they buying less real estate, but they are simultaneously selling their investment properties as well. This is producing huge numbers of homes available for sale on the market at the same time that record new home construction floods the market. These two increasing supply forces, the increasing supply of existing homes for sale coupled with the increasing supply of new homes for sale will further exacerbate the problem and drive all real estate values down.

A recent survey showed that 7 out of 10 people think the real estate bubble will burst before April 2007. This change in the market psychology from ‘must own real estate at any cost’ to a healthy concern that real estate is overpriced is causing the end of the real estate market boom.

The aftershock of the bubble bursting will be enormous and it will affect the global economy tremendously. Billionaire investor George Soros has said that in 2007 the US will be in recession and I agree with him. I think we will be in a recession because as the real estate bubble bursts, jobs will be lost, Americans will no longer be able to cash out money from their homes, and the entire economy will slow down dramatically thus leading to recession.

In conclusion, the three reasons the real estate bubble is bursting are higher interest rates; first-time buyers being priced out of the market; and the psychology about the real estate market is changing.
